Processing Orders.

Energy8.ro does not condition the placing and acceptance of orders by exceeding the value of a minimum amount. When placing an order in the online store Energy8.ro, the buyer expresses his agreement with the electronic communication method via email.

The transmission of the order on the website will be followed by the receipt of an automatic email that only confirms the placing of the order. This message, the discussions by phone, by email or by other means with the representatives of the seller do not constitute firm acceptance of the order, and implicitly do NOT mean the conclusion of the contract at a distance. The automatic issuance of the confirmation of receipt of the order is NOT equivalent to the conclusion of the contract between the seller and the buyer. Confirmation of an order is made after checking the order and the stock of the products in the order. This confirmation is made only by a sales agent, by telephone or electronically (e-mail);

Confirmation of the order by the seller to the buyer, by phone or by email without requiring any confirmation at the time of the conclusion of the contract constitutes the distance . The message of the accepted order is the annex to the contract.

The products included in the orders accepted by the Seller will be delivered according to the conditions stipulated regarding the payment and the delivery.

The buyer can cancel an order before receiving the shipment confirmation message, by sending an email to contact@energy8.ro. 

The buyer can return the product / products following the procedure described in the section "Return policy".

Billing of Orders.

Each confirmed order specifies the products, prices, method and term of payment. The seller will issue a tax invoice to the Buyer appropriate for the goods and services delivered. The buyer has the obligation to provide all the correct information necessary to issue the fiscal invoice in accordance with the legislation in force.

Prices and product information.

All prices presented in the online store Energy8.ro include VAT (19% for legal entities and 5% for individuals). Prices do not include delivery costs, except for cases where this is specified on the product page. The prices printed on the fiscal invoice issued Buyer will be identical to those specified in the order acceptance message by the seller.

The content of the site (texts, product names and descriptions, technical characteristics, images, symbols) is compiled in collaboration with the representatives of the manufacturers/suppliers of the listed products and may be incomplete for reasons related to space and/or the structure of the information.

For this reason,  The seller does not assume responsibility for the product descriptions presented on the website.

The seller and its suppliers reserve the right to modify the technical specifications and prices of the products without prior notification. The images of the products are presented in the online store Energy8.ro as an example and may be different from the delivered products (by color, accessories, appearance, etc.).

In case the prices or other details related to the products have been displayed incorrectly, including due to the fact that   have been incorrectly entered into the database, we reserve the right to CANCEL the orders containing these products and to notify customers as soon as possible about the error that occurred

Stock information.

In the list of products of each category or on the page of each product, information on available stocks is displayed.

Prices and stocks are updated from an interval of 24 hours to 5 days.

Depending on availability, the possible statuses are:

      - In stock - the product may be in stock immediately.

      - In supplier stock - the product is in the supplier's stock and can be delivered in an average term between 2 and 15 working days, within the limit of available stock.

Payment methods.

The products ordered from the online store Energy8.ro can be paid in advance or upon delivery.

The accepted payment methods are:

     – With cash, to courier

     – By bank transfer

Guarantees.

Products sold on the websitewww.energy8.ro  benefits from the guarantee in accordance with the legal provisions in Romania. In order to benefit from the warranty offered to products or photovoltaic systems, they must be installed only by authorized companies. The warranty does not cover installation defects.

The laws governing the product warranty are:

     -Law no. 193 of 2000 on unfair terms in contracts concluded between traders and consumers;

     -Law no. 296 of 2004, regarding the Consumer Code, amended by Law no. 161 of 2010;

     -Law no. 161 of 2010 to amend Law no. 296 of 2004 and Law no. 193 of 2000 on unfair terms in contracts concluded between traders and consumers.

Warranty of Conformity. Covers the legal protection of the consumer in respect of the non-conformity of the product and obliges the seller to bring the product to the state of conformity without requiring additional costs. This aspect can be achieved by returning the price paid, repairing, replacing the product if it does not correspond to the mentioned specifications.

The warranty of conformity does not cover technical defects, it is 2 years (except for products whose average duration of use is less than 2 years, in this case the 2-year term will be reduced to the average duration of use.)

Non-conformity must not be proven by the consumer in the first 6 months (it is considered to have existed at the time of product purchase), subsequently, for the period up to 2 years, the lack of conformity must be proven.

The commercial guarantee. Represents the commitment to the consumer, without requesting additional costs, to repair, replace, or, when these are not possible, to refund the price paid.

Legal guarantee. Is granted on the basis of the Certificate of Guarantee issued on the basis of the commercial guarantee. The certificate will contain the product identification elements, the warranty period, the average duration of use, the specialized service units.

To receive a product for service you need the completed and stamped warranty certificate, purchase invoice and proof of payment.

In addition to the Warranty Certificate, the buyer will also receive the purchase invoice, the installation and use manual of the product, the technical specifications and the certificate of conformity.

The repair deadlines of products under warranty are as follows:

     -maximum 30 calendar days for individuals.

     -maximum 30 calendar days for legal persons.

Delays may occur during these terms, but the remediation period will only be extended with the written consent of the buyer.

Warranty Exclusions:

      - products on which unauthorized interventions were carried out;

      - installation, assembly, commissioning and use in improper conditions and negligence in use,

      - products that present physical defects caused by mechanical / electrical / thermal shocks (breaks, scratches, burns , deformations, etc.);

     -oxidation, penetration of liquids or foreign bodies into products;

     -damage or destruction of labels, seals, manufacturing series;

     -modifying or completing the data in the warranty certificate. Any change made must be accompanied by a signature and stamp.

Processing of personal data.

The information provided is kept under security conditions and will be used only for the purpose agreed by the Buyer at the time of their collection, according to the laws in force.

By placing an order, the buyer is expressing consent to receive electronic commercial messages from the seller on the email address provided. The buyer will have the opportunity to later modify the registered address and to filter the messages he would like to continue receiving from to the buyer.

Provoice Marketing Solutions SRL respects all the mentions of law 677/2001 Article 12(1) line C:

  ”  additional information, such as: recipients or categories of data recipients; whether the provision of all requested data is mandatory and the consequences of refusing to provide them; the existence of the rights provided for by this law for the data subject, in particular the right of access, intervention on data and opposition, as well as the conditions under which they can be exercised"

Major force and litigation.

None of the contracting parties will be responsible for non-performance of its contractual obligations, if such non-performance is due to a major force event. Major force is the unforeseeable event, beyond the control of the parties and which cannot be avoided.

This Agreement is subject to Romanian law.

Any disputes arising between the buyer and the seller will be resolved amicably, calling the number 0750.444.765 or at contact@energy8.ro, and if an agreement is not reached in this way, the competent courts will be appealed.
